    Seems lesbian lust has run amok in Kansas. Two lesbians ran a craigslist ad for a sperm donor for their child back in 2009.

    Since the birth of the child, to two have split, both seeking welfare benefits for the child

    The state found out who the sperm donor is, and is now suing him for child support.

    let that be a lesson to all the sperm donors of lesbian couples who had a child with donated sperm…

    Interesting case. First question, is the contract legal? If not, it is void and meaningless.
    For example, I sign a contract promising to pay you a $ if the Raiders don’t win the Superbowl. Unenforceable if gambling is illegal.

    The so-called contract is worthless. How can two parties enter into an agreement to absolve the father from any responsibility for child support when state law says the state can go after him? There’s a lot of information missing from the story, like does one mommy have the child and the other has to pay support? The story says they are both seeking state aid. The story also doesn’t say how insemination was achieved (other than not professionally done). Seems like this guy has left himself exposed (pardon the pun) to being on the hook. And of course the mommies want to blame the state for the mess. Sounds like entitlement mentality to me.

    Well those Kansas regulations are odd. If the insemination isn’t performed by a licensed physician, any agreement between the donor and the mother is void. Wonder who got that piece of legislation enacted. Maybe the AMA? It’s not merely a problem of foresight on the donor’s part. It’s also smells like an interest group got legislation enacted to punish people for not retaining the services of a physician. In other words, if you want an insemination, you are forced to pay a licensed physician even if the ole turkey baster method can do the job for nothing. And finally, these women signed up for the responsibility of parenthood no matter if they couldn’t maintain their relationship. While the guy is definitely guilty of a serious lack of foresight, the burden of supporting the child is on the women, not the state. If they had any serious morals they’d withdraw their application for aid and get a job.

    I’d think the natural mother (or unnatural mother, in this case) would get custody. The lesbo partner obviously is not the father; the male donor is. He doesn’t want custody; the lady who popped the kid gets to keep it.
    But since he’s the natural father (or unnatural father, in this case) and state law says he has a responsibility to support his child, then he pays child support.
    I’ve heard of do-it-yourself abortions; do-it-yourself inseminations? Look for preggie kits at your local hobby shop soon.

    While I agree with MM that this case shows a lack of foresight, and maybe also of any understanding of the way of the world, it is no different than any other situation where a man and a woman, married or not, get together and make a baby. The woman cannot simply absolve the man of any responsibility for this baby being born and go and ask the people to pay for raising the child. Also, the legislation enacted by the “interest group” is not to punish the do-it-yourselfers but to protect the legitimate clinics and their anonymous donors who provide a service for those need it. That interest group is the state, aka the people.
